1. Acceptance of Terms
Please read these Terms and Conditions ("Terms") carefully before using the GraduateHelper service ("Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Service.
2. Description of Service
GraduateHelper is an AI-powered platform that helps students find graduate programs and PhD supervisors matched to their academic profile and research interests. The Service analyses user-submitted data and CV documents using artificial intelligence (AI) and a curated database of researchers to generate personalised recommendations. All recommendations are for informational purposes only and do not constitute a guarantee of admission, funding, or any particular outcome.
3. Eligibility
You must be at least 18 years of age to create an account and use the Service. By registering, you represent and warrant that you meet this age requirement and that all information you provide is accurate and complete.
4. User Accounts
When you create an account, you must provide accurate and complete information. You are solely responsible for safeguarding your password and for all activities that occur under your account. You must notify us immediately if you become aware of any unauthorised use of your account. We reserve the right to suspend or terminate accounts that violate these Terms.
5. Usage Quota
Each user is granted ten (10) searches per calendar month. This quota resets on the first day of each month. We reserve the right to modify the quota amount, introduce paid tiers, or change the quota policy at any time with reasonable notice.
6. User Content & Data
You retain all ownership rights to the content you submit, including your CV and personal information. By submitting content to the Service, you grant us a limited, non-exclusive licence to use, process, and transmit this data solely for the purpose of providing you with the Service. Your academic data (CV content, research interests, GPA, test scores, university name) may be sent to a third-party AI service for the purpose of generating recommendations. We will not use your content for any purpose other than delivering the Service to you.
7. Accuracy of Results
While we strive to provide accurate and helpful recommendations, the Service relies on AI-generated analysis and a database that may not be exhaustive or fully up-to-date. We do not warrant that the information in our results (including programme details, deadlines, rankings, funding information, or admission chances) is accurate, complete, or current. You should independently verify all information before making academic or financial decisions. GraduateHelper is a research tool, not a substitute for professional academic advising.
8. Prohibited Conduct
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
- Create multiple accounts to circumvent the usage quota.
- Upload malicious files or content designed to exploit or damage the Service.
- Attempt to gain unauthorised access to any part of the Service, its servers, or any connected systems.
- Scrape, crawl, or use automated means to access the Service without our express written permission.
- Resell, redistribute, or commercially exploit the Service or its results without authorisation.
9. Payments & Refunds
If you purchase a paid plan or additional searches, payment is processed securely by Stripe. All prices are displayed before purchase. Due to the nature of digital services where results are delivered immediately, refunds are generally not available once a search has been performed. If you experience a technical issue that prevents delivery of results, please contact us at helpergraduate@gmail.com and we will work to resolve the issue or provide a credit.
10. Account Deletion
You may delete your account at any time using the "Delete Account" feature. Deleting your account will permanently and irreversibly remove all your personal data, uploaded files, and search history from our systems. This action cannot be undone. We may also terminate or suspend your account at any time, without prior notice, if you breach these Terms.
11. Intellectual Property
The Service, including its design, software, database, and content (excluding user-submitted data), is the intellectual property of GraduateHelper and is protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works of the Service without our express written permission.
12. Disclaimer of Warranties
The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that the results obtained will be accurate or reliable.
13. Limitation of Liability
To the fullest extent permitted by applicable law, the operator of GraduateHelper shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of the Service. Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you have paid us in the twelve (12) months preceding the claim.
14. Indemnification
You agree to indemnify and hold harmless the operator of GraduateHelper from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
15. Changes to These Terms
We reserve the right to modify these Terms at any time. Any changes will be posted on this page with an updated "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the new Terms. We encourage you to review this page periodically.
16. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Switzerland, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Switzerland.
17. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms shall remain in full force and effect.
